Aura and Luck Regulatory Summary Regarding the Telephone Consumer Protection Act (TCPA)
The federal Telephone Consumer Protection Act (TCPA), related FCC regulations, and court interpretations protect consumers from specific types of telemarketing practices. Under the TCPA, "telemarketing" is defined as "the initiation of a telephone call or message for the purpose of encouraging the purchase or rental of, or investment in, property, goods, or services, which is transmitted to any person." (47 C.F.R. § 64.1200(f)(12)). The TCPA restricts cold calls, prerecorded sales calls, and the use of autodialers. It also authorized the creation of the National Do Not Call Registry. Key TCPA requirements include:
  • Restricting cold calls, prerecorded sales calls, and autodialer use.
  • Prohibiting calls/texts to numbers on the National Do Not Call List (DNC) or business' internal DNC list.
  • Requiring prior express consent for calls to cell phones using autodialers or artificial/prerecorded voices.
  • Mandating caller identification (name/location/company).
  • Prohibiting unsolicited faxes unless an established business relationship exists and the fax includes an opt-out provision.

Aura and Luck Do Not Call Policy
National Do Not Call Registry
Established in 2003 by the FTC and FCC, the National Do Not Call Registry is a list of phone numbers (residential and mobile) from consumers who do not wish to receive telemarketing calls. Calls to registered numbers are prohibited unless:
  • The caller has an existing business relationship with the consumer, or
  • The consumer provided prior express consent to be called.
Aura and Luck Practices and Procedures
Internal Compliance Commitment
All employees, contractors, vendors, or third parties acting on behalf of Aura and Luck ("Aura Representatives") must adhere to TCPA and state-specific telemarketing laws. Noncompliance may result in legal penalties, contract termination, or disciplinary action.
Internal Do Not Call (DNC) List
Consumers who request to be added to our internal DNC list must notify the Customer Experience Department within five (5) business days of their request.
The Customer Experience Department will update the Internal DNC List within 30 days of receiving a request.
Calls/texts are prohibited to numbers on the Internal DNC List, State DNC Lists, or National DNC List unless specific exemptions apply (see below).
 
Exemptions to Calling Restrictions
Calls may be made only if:
  • The consumer had an established business relationship with Aura and Luck within the last 18 months (based on prior transactions or inquiries), or
  • The consumer provided express consent within the last 3 months, or
  • The consumer has a personal relationship with the caller.
Calling Time Restrictions
Calls may only be made between 8:00 a.m. and 9:00 p.m. (local time of the recipient) unless prior express permission is granted.
Required Caller Disclosure
During calls, Aura Representatives must provide:
Caller’s name and company affiliation.
Company name/address or toll-free phone number (900 numbers prohibited).
A statement that the call’s purpose is to solicit products/services.
Reporting Violations
Violations must be reported to the Director of Marketing immediately. Complaints should be directed to the Customer Experience Department for resolution.
